Introduction

PLEASE READ THESE TERMS OF USE FOR THE FOOTPRINT REWARD PROGRAM CAREFULLY. BY ACCESSING OR USING THIS PROMOTIONAL PROGRAM, YOU AGREE TO BE BOUND BY THE TERMS DESCRIBED HEREIN AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT PARTICIPATE IN THIS PROGRAM.

These Terms of Use apply to your access to, and participation in, the Footprint Reward program (“Footprint Reward”) which is operated by Perpetual Guardian Ltd (“Perpetual Guardian”). These Terms of Use do not alter in any way the terms or conditions of any other agreement you may have with products, services or otherwise. For the avoidance of doubt, these Terms of Use are in addition to the Footprint terms, available at www.myfootprint.co.nz/terms-conditions.

Footprint and Perpetual Guardian reserve the right to change, modify and/or terminate the Footprint Reward program and/or these Terms of Use or any policy, FAQ, or guideline pertaining to the Footprint Reward program at any time and at its sole discretion. Any changes or modifications will be effective immediately upon posting the revisions to www.myfootprint.co.nz, and you waive any right you may have to receive specific notice of such changes or modifications. Your participation in the Footprint Reward program confirms your acceptance of these Terms of Use and any such changes or modifications; therefore, you should review these Terms of Use and applicable policies from time to time to understand the terms and conditions that apply to the Footprint Reward program. If you do not agree to the Terms of Use, you must stop participating in the Footprint Reward program.

The Footprint Reward program is not targeted towards, nor intended for use by, anyone under the age of 18.

Please read the Privacy Policy carefully to understand how Footprint collects, uses and discloses information about its customers.

Footprint Reward Program Definitions and Interpretations

Subscription Customers: A person that pays an annual fee for a Footprint package.

Footprint Customer: A person that has activated their account.

Account: A customer’s individual access to their Footprint Subscription-based products and services.

Reward Discount: A discount in estate administration fees provided by Perpetual Guardian.

Recent Will: The last Will created on the Footprint platform or with Perpetual Guardian if the subscription customer was referred to Perpetual Guardian to create a complex Will; which has also been signed and witnessed correctly according to legal requirements.

Arrears: Outstanding / overdue payment of subscription fees.

Executorship / Executor: A third party appointed in a Will to distribute the estate of the Will writer.

Sub Executor: A backup to the appointed Executor in the event that the appointed Executor is unable or unwilling to perform their Executorship duties.

Status: Identifies the customer type, e.g. a retail customer or an employee benefits customer.

Eligibility

Only Footprint customers that select or have the Footprint Will It Package and subsequently select Perpetual Guardian as executor in their most recent Will are eligible for the Footprint Reward. In order to be eligible for the Footprint Reward program, you must have:

  • a valid personal email address;
  • an active Footprint Will It subscription account which isn’t in payment arrears; and
  • have appointed Perpetual Guardian to act as Executor of your most recent Will. The Footprint Reward program is available to individuals only.

General Conditions

  • The discount under the Footprint Reward program is only redeemable for the Perpetual Guardian executorship service. It cannot be redeemed against any other Footprint or Perpetual Guardian products, services or offers.
  • The Reward may only be redeemed once Perpetual Guardian’s Executorship services have been completed. Any discussions regarding fees or payment are to be held directly with Perpetual Guardian. Footprint is not responsible in any way for the services and or fees that are performed or charged by Perpetual Guardian.
  • Any questions or disputes regarding Executorship fees or services should be raised within 4 weeks of Perpetual Guardian’s services rendered. Queries should be sent to client.care@pgtrust.co.nz. Or visit www.perpetualguardian.co.nz/complaints/ for more details.
  • The Reward Discount may only be redeemed for the Executorship services provided for the estate of the subscription account holder and Will writer, being the same person.
  • Footprint and Perpetual Guardian’s standard terms and conditions and privacy policy apply to all services rendered.
  • The Footprint Reward Discount is not redeemable if Perpetual Guardian is selected as a Sub Executor in the Will.
  • If the Will that appoints Perpetual Guardian as Executor has not been signed and witnessed correctly causing it to be legally invalid, Reward Discounts will not be redeemable.
  • All Footprint customers that elect to change and or update their existing Wills in order to join the Footprint Reward program, do so knowing that they are requesting that Perpetual Guardian be appointed as Executor of their Will.
  • If you are bringing your own (BYO) Will to Footprint and elect to be part of the Footprint Reward program, by accepting the terms and conditions you accept that if Perpetual Guardian is not listed as the Executor the discount will be forfeited.
  • By signing up for the Footprint Reward program, you consent to the collection, storage, use and disclosure of your personal information in accordance with our Privacy Policy.
  • If you hold two Footprint subscription accounts and are a member of the Footprint Reward program for more than one, only one subscription account’s Rewards Discount is redeemable. In this instance, the greater of the two Rewards Discounts will be applied to the Perpetual Guardian Executorship fees. Reward Discounts cannot be merged together.
  • Any customers that participate in the Footprint Reward program, that move between their employee benefits program to Footprint’s retail service or vice versa, have the opportunity to retain any Reward Discounts already accumulated if the account does not fall into arrears and we are notified of the status change within 4 weeks.   • Perpetual Guardian and Footprint reserve the right to notify law enforcement agencies and to pursue any remedies that may be available in the case of improper use or fraudulent activity in relation to the Footprint Reward program or any other systems.
  • The standard annual rate of the discount collected is valued at $100 on year one after the Will has been submitted and each consecutive year of the subscription renewal. No partial or prorated discount values will be applied; each term for accrual is one full calendar year.
  • Any instance where it is found that the information provided to join the Footprint Reward program is identified is untrue or inaccurate, the Footprint Reward discount and any subscription fees paid will not be redeemable or refundable.
  • Except for any liability that cannot be excluded by law, Footprint and or Perpetual Guardian will not be liable for any loss or damage; whether direct, indirect, special or consequential, arising in any way out of the Footprint Reward program, including but not limited to, where arising out of: (a) any technical difficulties, network failures, virus or equipment malfunction (whether or not under our control); (b) any loss, theft, unauthorised access or third party interference customer information; (c) any discounts that are not properly recorded against a customer’s Footprint Rewards discount; and (d) participation in, or termination of, the Footprint Reward program.

Cancellation / Payment Arrears

  • On cancellation of the Footprint Reward program or the Footprint subscription product all accrued Reward Discounts are forfeited.
  • Subscription accounts that are cancelled cannot redeem the Reward Discount for cash or transfer it to any other product or service with Footprint or Perpetual Guardian.
  • Subscription accounts that go into arrears for a period of 4 weeks are cancelled, which also cancels the Footprint Reward program participation. Any Footprint customer looking to back pay the amount in arrears may do so within 4 weeks of the first missed payment without losing the Reward Discount. Any time after this will result in the Reward Discount returning back to zero. This includes payment of outstanding arrears after the 4 week grace period.
  • In order to redeem the Reward Discount, the subscription account must have been up to date and not showing any arrears payment outstanding. The 4 week grace period applies but any fee outstanding beyond this effectively sets the Reward Discount back to zero.
  • In the event the subscription fees are in arrears greater than 4 weeks and the Reward Discount has been set back to zero, Perpetual Guardian’s standard Executor fees will apply. See here to view their standard fees.
  • Your Footprint Rewards discount is not transferable against estate administration fees of any other person. A customer may terminate their participation in the Footprint Reward program at any time by giving notice in writing and/or removing Perpetual Guardian as their appointed executor. All accrued Reward Discounts are automatically forfeited on termination.
  • Where a customer wishes to remove themselves from the Footprint Reward program by removing Perpetual Guardian as their appointed Executor, it is acknowledged that the cost of doing so will be at their own expense. Perpetual Guardian may cancel any membership of the Footprint Reward program at any time at its absolute discretion. However, all Reward Discounts accumulated will be applied against any Perpetual Guardian Executorship fees charged.
